Internet Access Service
Agreement
- InterTrek Technologies, LLC, a Connecticut Corporation, agrees to provide, and Client
(Client is the person or entity whose signature appears at the bottom of this Service
Contract) agrees to receive, access to the internet via InterTrek's network according to
the following terms and conditions: The following bold words in quotation marks are to be
defined and understood herein as follows:
"Contract" or "Agreement": Any and
all agreements for products, services and prices entered herein on this Contract. "Account":
Any and all business contracted for and/or engaged in between client and InterTrek
Technologies, LLC, including but not limited to InterTrek web service, as described
herein.
"Services": All services provided to client by InterTrek
including but not limited to Internet Access, InterTrek Web Server, FTP Access, E-Mail
Server, etc. "Provider": InterTrek Technologies,
LLC, and
InterTrek Technologies' services, products and hardware.
1) Internet access will be activated only after InterTrek is in receipt of this agreement,
signifying acceptance of terms and authorization of payment. Effective billing date is the
day the subscriber’s account is activated.
2) Written notice is required to cancel Internet service and to cease billing and payment
arrangements. Refunds are not granted for partial months of service in the event of
cancellation. Invoices will be sent by electronic mail ONLY.
3) Though the usage of accounts is unmetered for billing purposes, subscriber acknowledges
that all dial-up Internet access accounts are not to be used for providing data services
or for dedicated connections. Any attempt to maintain a dedicated, permanent connection
may result in the termination of the subscriber’s account. Connections that are
inactive may be disconnected from the network. Customer agrees to read and abide by
additional Acceptable Use Policies posted on the
InterTrek site on the World Wide Web (http://www.intertrek.net). Customers who violate Acceptable Use Policies as defined by InterTrek may
have their accounts suspended or terminated without notice, and are liable for any expense
incurred by InterTrek as a result, including network administration hourly charges.
4) Subscriber agrees to pay InterTrek all fees associated with Internet service in
accordance with the accompanying Schedule of Fees. Payment is due no later than 30 days
from the effective billing date. Payments not received within 30 days are subject to 1.5%
per month interest charge, and past due accounts are subject to termination without
notice. There is a $20 charge for returned checks.
5) InterTrek Technologies, LLC, agrees to provide the highest practical level and quality
of service. However, InterTrek makes no express or implied warranties of service in
connection with use of Internet access. The subscriber agrees that InterTrek is not liable
for any loss of service, loss or damage to equipment or software or any other loss,
damage, or inconvenience resulting from reliance on or use of Internet access.
6) Subscriber agrees that InterTrek Technologies, LLC is not responsible for the content
of material accessed or obtained through use of an Internet account.
7) InterTrek Technologies, LLC agrees to offer technical support for Internet software
provided by or purchased from InterTrek. InterTrek agrees to make a good-faith effort to
help subscribers with other Internet software they may choose to use. InterTrek does not
warrant that Internet software will work on any particular computer. Software provided by
InterTrek may be exchanged, software purchased is nonrefundable.
8) InterTrek Technologies, LLC reserves the right to change the terms and conditions of
this agreement without notice.
9) Subscriber understands, agrees, and accepts that access to the Internet through
InterTrek Technologies, LLC is authorized for the subscriber only. Subscriber must be at
least 18 years of age or have the signature of parent or guardian.
10) The term of this agreement shall be one month, beginning on the date subscriber’s
account is activated. The agreement shall renew monthly unless terminated in accordance
with procedures set forth in this agreement.
